英文摘要	以正当性与合法性来论证刑法制度的正确性是普适的，作者以此为架构上的坐标体系，运用思辨的方法，对“赔钱赎刑”进行考察。本文除了引言与结语、后记，还分四个部分。引言中以广东东莞中院公布案例引发轩然大波为引子，引出对“赔钱赎刑”正当性与合法性的考察。第一部分，作者从四个方面考察“赔钱赎刑”的正当性：1、“赔钱赎刑”符合刑事司法政策。2、“赔钱赎刑”符合价值目标的要求。3、“赔钱赎刑”符合恢复性司法理念的要求。4、“赔钱赎刑”符合法的价值判断标准。5、“赔钱赎刑”能弥补法律固有的缺陷。第二部分，作者从二个方面展开对“赔钱赎刑”合法性的考察。1、“赔钱赎刑”合法性的理论基础。2、“赔钱赎刑”合法性的法律...; It is universal to use legitimacy and legality in justifying the correctness of criminal law system.
