| 英文摘要 | 机会丧失理论作为一种独具特色的制度,在英美普通法系国家得到了比较充分的研究,而与此形成鲜明对照的是，我国对于机会利益丧失的救济，无论是理论界还是实务界均持保守的态度。根据我国侵权法理论的通说，可赔偿损害包括直接损害与间接损害，前者指现实利益的丧失，而后者指受害者如不受损害必然得到的利益，这实际上是将可能得到的利益排除在法律的保护范围之外。这种理论直接影响了立法，导致我国并未对机会损失给予足够的重视。由于机会损失的不确定性，而且不易量化，为了防止不确定性的扩张，保持法律的稳定性和保险金计算的精确性，保守的规定成了当然的选择。但是，技术上的瓶颈绝不应该做此保守规定的理由，也没有彻底贯彻民法作为权利...; The theory of loss of chance（hereinafter called” the theory”）has evolved through the practice of common law into a unique institution, No matter in scientific principle or in judicial practice, it is certain that the doctrine of loss of chance always keeps the conservative stipulation in china.
