| 英文摘要 | 刑讯逼供曾经作为国家司法机关获取犯罪嫌疑人口供的有效方式而合法存在。随着社会的进步、人类文明的发展，刑讯逼供因其公然践踏人权而与现代法律背道而驰，受到了现实的批判和法律的禁止。然在司法实践中，刑讯逼供却仍然屡禁不止。本位在阐述了刑讯逼供的内涵、危害及在当代中国的立法与司法现状后，从刑讯逼供产生的原因入手，首先分析了以往学者观点对刑讯逼供产生原因论证之不足。其次提出，在当代中国执法人员的不健康心理是刑讯逼供的诱因、错误的法律观念是催生刑讯逼供的助燃剂、现行诉讼制度的不健全为刑讯逼供留下生存空间、传统集体本位价值观负面影响是刑讯逼供存在的重要原因。最后在借鉴西方国家反对刑讯逼供过程中尊重个人价值和...; Extorting a confession by torture had once existed legally as an effective way for national judicial authority to extorting a confession from criminal suspects.
