| 英文摘要 | 随着社会关系的日益复杂化，民事裁判效力不再限于只影响诉讼参加人，有时会影响甚至侵害到未参与原审审理的案外人的利益。针对这一问题，一些国家和地区的民事诉讼法确立了专门的救济机制——第三人撤销诉讼。为了对利益受他人判决损害的第三人规定一种及时救济程序，本文从现实案例出发，考察法国及我国台湾地区第三人撤销诉讼制度，提出我国民事诉讼法应建立独立型第三人撤销诉讼。全文除引言和结语外，分为五章。 第一章介绍了第三人撤销诉讼的国内外现有规定、定义及特征。第三人撤销诉讼起源于法国，法语表达为“tièrceopposition”，我国学者将其译成第三人提出取消判决的异议。在我国台湾和澳门的民事诉讼法中，第三人...; As the social relationship becomes more and more complex, the effect of civil verdict influences not only the litigants, but also the third parties who does not take part in the case.
