英文摘要	破产程序中的管理人制度是我国新《企业破产法》适应国际通行规则设立的一项全新的重要制度。破产管理人在企业破产过程中有着十分重要的作用，直接影响到破产程序的目的和全体债权人以及破产企业的利益。我国原有破产法律制度中的清算组虽然在一定程度上发挥了管理人的作用，但由于成立时间晚、独立性差、缺乏承担民事责任能力，不能满足破产程序的要求。管理人制度的确立对于人民法院及时、高效、公正审理企业破产案件将会产生积极的作用。 《中华人民共和国企业破产法》及最高人民法院相继制定的司法解释，对管理人的资质、选任作了较为明确的规定，采取法院选任、个案随机指定的方式。但现行法律规定存在诸多不足，不利于培育全国统一的管理...; The system of trustee in bankruptcy procedure is newly-established by the revised amendment of bankruptcy law, which purpose is to adapt to international common rules.
