| 英文摘要 | 在当事人的诉权得到尊重和保护的今天，由于对诉讼趋利性的追求，或出于人性恶的一面，常出现诉讼当事人单方或双方之间恶意串通，采取虚假陈述、伪造证据、虚构法律关系、虚构事实等手段，欲达到诈取国家、社会或他人合法财产、财产性利益或损害他人名誉等不法、不当目的的恶意诉讼情形。此类案件或因串通而具有很强的隐蔽性，或因诬告而具有很大对抗性，容易造成法院误判和社会不稳定，危害巨大。基于以上原因,笔者试从恶意诉讼的特点及构成要件出发，结合审判实务中出现的恶意诉讼情形，进一步分析恶意诉讼的成因，并针对我国目前处罚恶意诉讼行为规范缺位和法官甄别恶意诉讼能力不高的情况，从立法、司法角度探讨新形势下识别、防范和处罚恶意...; Recently the rights of parties have been greatly respected.
