| 英文摘要 | 格式条款是当事人为了重复使用而预先拟定并未与对方协商的条款。它是人们追求效益的必然产物。格式条款的广泛、重复应用，大大促进了社会经济的发展，但格式条款本身也存在着不合理的地方。由于格式条款提供者多为处于垄断或独占地位的企事业单位，其往往凭借优势的经济地位，追求己方最大利益，在合同中规定不平等条款，严重损害相对方的合法权益，挬离了公平、正义的法律价值。因此，要在发挥格式条款的最大价值，就应该在充分分析其利弊情况下合理利用，并客观面对其现实存在的弊端，通过对格式条款各方面的规制，以达到自由与正义、私人利益与社会利益的平衡。笔者即从格式条款的性质、法律特征、产生和发展入手，进而对格式条款的利弊做综合...; Standard terms are prepared in advance by a party for repeated use and not negotiated with the other party.
