| 英文摘要 | 国际贸易实践中，信用证的议付问题引发了很多争议。而在我国，由于国内信用证法律制度的不完善以及银行希望降低法律风险的出发点等因素，我国各大银行往往选择叙做出口押汇而避开真正的信用证议付。本文将对信用证议付和出口押汇展开全面分析，比较二者的性质特点，为我国信用证议付与出口押汇实践的规范与统一提出建议。 本文共分为五个部分。第一章对信用证议付与出口押汇进行概括论述，简要介绍了议付信用证的种类、特征，以及出口押汇的操作流程。第二章阐释议付信用证的法律问题，着重分析了议付信用证的法律定义，并对议付信用证下议付行的权利义务做了简要分析。第三章对出口押汇的相关法律问题做了详细论述，深入分析了出口押汇的定义...; In the practice of international trade, the negotiation of L/C has lead to a number of controversial issues.
