| 英文摘要 | 商业外观的法律保护在我国已不是新兴的话题，自2004年至今无论是法律条文还是司法实践都显示出我国对各类商业外观进行保护的迫切需求和快速发展。2010年，最高人民法院在一份民事裁决书中首次将产品形状纳入反不正当竞争法保护的范畴，至此包括产品包装、企业服务外观和产品形状三大类型的商业外观都成为我国反不正当竞争法的保护客体，利用反不正当竞争法保护商业外观已成定局。但伴随创造性司法实践而来的是有待解读的新标准和亟待完善的具体制度。在这样的背景下，本文从反不正当竞争法视角探讨对商业外观的保护，其中要明晰的核心问题是——我国商业外观的保护条件有哪些以及如何判断这些条件。 研究思路上，笔者主要沿着两条讨论...; Trade dress protection is no longer a brand new topic in China.
