| 英文摘要 | 内容摘要 内容摘要 本文通过审视检察机关量刑建议制度的发展过程，发现其存在的问题，分析其产生这些问题的原因。从比较法的角度出发，展示中外量刑建议对我国的启示。从具体案件的审理和立法的视角着手提出解决问题的建议。文章运用现状分析、演绎推理、比较研究等方法，得出应全面有效行使检察官量刑建议制度来解决公诉权行使中存在缺陷问题的结论。文章分四个部分： 第一章讨论检察机关量刑建议制度的必要性与可行性。作者认为，我国检察官行使公诉权过程中，凸现的还只是行使定罪请求权，对作为公诉权一部分的量刑建议权还没有全面和完善行使。作者认为提出在构建中国控辩对抗的诉讼模式之下，完全必要对检察官求刑权予...; ABSTRACT The thesis exames sentencing suggestion system of procuratorial authority to find inner problems and analyzes reasons of it.
