| 英文摘要 | 前科消灭制度，凸现刑法的谦抑性，能够有效地预防有前科者再犯而备受各国刑事立法的推崇，理论上也受到各国刑法学者的广泛认同。但我国刑法尚未确立这一制度，学界对此也缺乏应有的关注。笔者认为，结合我国司法实践，借鉴外国刑法中的前科消灭制度的“合理内核”，对我国刑法理念的更新和前科消灭制度的刑事立法具有十分重要的意义。 作者将本文分为四章。从各个方面对前科及其消灭制度进行了较为深入的探讨。 第一章分为四节。第一节主要介绍了前科的定义、前科的法律后果、前科制度的不足之处；第二节对前科消灭的定义进行了深入的探讨；第三节着重从世界范围来考察前科消灭制度。第四节重点考察了中国是否存在前科消灭制度。 第二章...; The system of expungement of criminal records can realize the justice, equality of law, protruding the thrift quality of criminal law, preventing the criminals who have criminal records recommitting effectively.
