| 英文摘要 | 内容摘要 中国转型社会时期，社会秩序混乱、社会道德水平下降。国家机关工作环境出现不同程度恶化的情况。不良的国家机关工作环境易使国家工作人员陷入了难以选择合法职务行为的困境，职务犯罪因此发生。对这类职务犯罪如何看待和妥善解决，就是本文所要研究的职务犯罪期待可能性问题。文章以期待可能性理论为指导，分析了职务犯罪期待可能性问题的表现和成因，提出了促进职务犯罪刑事法治人性化和解决职务犯罪期待可能性问题的看法。 本文分为前言和正文两个部分，其中正文分为四章： 第一章是期待可能性理论的概述。期待可能性理论是研究行为人主观方面的理论。该理论不仅具有丰富的人性内含，还具有防止客观归罪、换位思考等功能...; ABSTRACT In the period of china social transition, the chaos of social order occurs, the social morality deteriorates, and the work environment of the state organs becomes worse.
