| 英文摘要 | 违宪审查制度是保障宪法成功实施的核心，是一个宪政国家的题中应有之义，违宪审查制度的正常运转与否，直接关系到宪法限制政府权力、保障人权的作用能否得以实现。从宪政的内涵来看，其核心在于限制政府权力；目的在于通过限制政府权力来保障人权。因此，保障人权是违宪审查制度的终极目标。 日本现行宪法实施65年来，虽然当今日本各界对于这部带有强烈美国印记的宪法仍众说纷纭，莫衷一是，但不可否认的是，第二次世界大战以后，日本正是在这一宪法的指导下，走上了战后重建、经济恢复、兴国安邦的和平发展道路，而日本宪法也因此成为美国法在亚洲成功移植的范例。这其中，违宪审查制度起到了不可替代的重要作用。虽然日本违宪审查制度建立...; Judicial review system is the core to guarantee the success of constitution’s implementation.
