英文摘要	有关数据显示，我国海洋环境保护现状不容乐观。设立专门的海洋环境监督管理机构是必要的，但谁能当好这个“监管者”的角色，让人忧虑。首先，行使海洋环境监督管理权的部门众多，“多龙治水”的监管体制能否有效协调好海洋生态损害索赔让人生疑。就目前我国海洋生态索赔案件中索赔主体混乱、错位的现状看来，有关国家机关就索赔权行使尚未能有效协调，不利于及时、有效对海洋生态损害进行索赔，影响了我国海洋环境的保护和改善。 本文拟从我国海洋环境保护立法现状入手，为理清有关国家机关海洋生态损害索赔权行使的界限，确定具体海洋生态损害索赔案件的主体提出建议，探索确定我国海洋生态损害索赔主体的方法。第一章分析我国海洋生态损害索...; The statistics brings bad news about marine environment.
