| 英文摘要 | 内容摘要 处理离婚纠纷时，作为婚姻住所的房屋的认定及分割一直是司法实践中的难题之一。20世纪90年代开始，我国住房制度改革，房地产市场持续升温，房产目前已经成为普通家庭的最大宗财产。在房产价值凸显的同时，由于按揭供房的普遍化、产权情况的复杂化、婚变发生的频繁化，离婚时围绕房屋产生的争议日趋增多。夫妻共有房屋既是夫妻共同财产的一项内容又是房屋所有权存在的一种形态，我国立法上关于夫妻共有房屋认定及分割的规定还有待完善，探讨夫妻共有房屋的认定及分割具有理论意义和现实意义。 本文除前言、结语外，正文包括三章。 第一章离婚时夫妻共有房屋的认定。夫妻共有房屋是指夫妻共同共有的房屋，它具有因婚姻关...; ABSTRACT In the divorce cases, housing is often the focus of controversies of the division of property for both parties to marriage.
