英文摘要	被誉为近代刑罚之花的自由刑，在刑罚体系中占有十分重要的地位，在我国尤其如此。如果说自由刑在我国刑罚体系中占据着中心地位，那么有期徒刑就是中心的中心。有期徒刑是我国刑法中适用范围最广泛的一种刑罚，在刑法分则条文中，凡是对犯罪规定法定刑的，都规定了有期徒刑的刑种。立足于这样一个基本事实，自由刑的中心——有期徒刑的完善应该成为我们对刑罚制度研究的重点之一。有期徒刑的完善有诸多方面，由于篇幅所限，本文主要讨论有期徒刑最高刑期的设置问题，即有期徒刑上限的设置。 全文由四部分组成： 第一章概述了有期徒刑的适用对象、刑期设置、执行及其优劣，并着重指出了我国有期徒刑上限偏低所带来的种种弊端，为下文的论述作...; Be praised as the flower of modern penalty, the free punishment occupies a vital important position in the penalty system, especially in our country.
