| 英文摘要 | 我国重陆轻海的历史传统源远流长，这既制约了国民的思维方式和行为方式，同时也对国家立法、行政管理模式产生了深远影响，往往忽视海洋特性，仅仅参照陆上行政管理模式实施海上行政管理，由此弊端频现。在海上行政处罚程序上，我国现有法律未区分海陆执法的不同需求及案件性质，海上适用与陆上完全相同的处罚程序。这种做法既限制了海上行政相对人的程序参与权与选择权，又无法运用繁简不同的程序对海上各类违法案件进行程序分流，以合理分配有限的行政执法资源，造成海上行政执法资源的巨大浪费。 本文针对以上情况展开了论述。本文除引言和结语外，共分三章。第一章重点从海上执法的特点、现行行政处罚程序存在的问题及其与海上执法效率的冲...; Influenced by the land-worshipped culture, since the ancient times，China has attached more importance to the land than the sea.
