| 英文摘要 | 在离婚诉讼中，夫妻共同财产的分割和共同债务的认定与分担日益成为当事人双方的争议焦点，特别是共同债务的认定与分担，由于其可能影响第三人的利益和交易安全，且法律规定得过于原则和简单，而成为夫妻离婚诉讼中的棘手问题。本文就这一问题进行了理论分析和实证研究，提出完善我国夫妻债务清偿制度的设想。全文分为前言、正文、结束语三部分。正文共分四章。前言指出了我国夫妻债务理论和实践的现状，说明了研究夫妻债务的现实意义。第一章夫妻债务概述。本章依据现有法律规定，对夫妻共同债务和个人债务的概念和范围作了界定，认为夫妻共同债务是指在婚姻关系存续期间，夫妻双方或一方为维持共同生活的需要；或出于为共同生活的目的从事经营活...; In divorce lawsuits, division of common properties as well as recognition and share of common debts of divorcing couples become hot points of dispute between them, especially in recognition and share of common debts.
