| 英文摘要 | 内容摘要在整个国际社会，反倾销作为一种合法的贸易保护手段被过于频繁的使用。而滥用反倾销会对公共福利造成很大的损害。因此，在反倾销法中引入“公共利益”原则是合理而必要的。欧共体反倾销条例中对“公共利益”问题做出了明确而具体的规定，走在国际反倾销法重构的前沿。本文首先从反倾销及公共利益的概念辨析入手,澄清了反倾销法中公共利益原则的本质在于提高社会整体福利水平。在对欧共体反倾销条例中公共利益规定发展历程回顾以及与各国相关立法比较分析的基础上，对欧共体现行反倾销条例中的公共利益规定进行了论述与评价。特别强调指出了其在制度设计及实践中的若干缺陷，并给出了完善的建议。最后，对照欧共体反倾销条例的分析给我国...; Abstract As a legal trade protection instrument, antidumping measure is overused in the whole world.
