| 英文摘要 | 近年来，随着社会的发展，越来越多的人选择诉讼方式维护自身合法权益和解决民事纠纷。这是社会法律意识不断增强的体现。但是随之而来的是，有些人利用诉讼这种合法的形式来掩盖其侵犯他人权益的目的。由于法律的滞后性，我国的实体法和程序法对此均未作出明确规定。正因为如此，虚假民事诉讼屡屡得逞，严重侵害了案外第三人的合法权益，同时，也造成司法资源浪费，干扰法律秩序，损害法律尊严。基于这样的现状，本文旨在通过对虚假民事诉讼的概念、特征以及现状的分析，提出对虚假民事诉讼进行规制的建议。除引言和结语外，本文正文共分为四章。 第一章从虚假民事诉讼的概念着手，在综合学界多种观点的基础上，对虚假民事诉讼的概念进行重新界...; In recent years, with the development of society, more and more and more people choose the way of lawsuit to safeguard their legitimate rights and to solve the civil dispute.
