| 英文摘要 | 内容摘要积案已成为困扰当今世界各国民事诉讼效率的普遍问题，各国司法制度的演进历史表明，法院和法官的数量总是与纠纷数量的不断增长、案件类型和复杂程度的逐步增加而成比例上升。然而，各国司法机构并没有无限地横向发展，而是普遍选择了增加审级，不约而同地汇入了三审终审的金字塔型结构，它们在实质上体现着相同的原理或相似的功能配置方式。相比之下，中国现行的两审终审制度因受制于政治、经济、文化历史背景等原因，在技术原理上呈现为审级功能层次不明、运作方式大致相同的柱型结构，与现代审级制度原理相悖，随着我国社会的变迁，暴露出种种弊端，面临着越来越严重的危机。本文在论述现代审级制度原理的基础上，分析、评价中国现行审...; ABSTRACT Over-burdening of cases has become the common problem that troubles the efficiency of civil litigation globally, the evolvement of judicial system in different countries has shown that, as there are more and more courts and judges, issue concerning the amount of disputes, the categories and complexity of cases arises gradually as well.
