| 英文摘要 | 我国法院调解历史悠长。然而，调解正式作为一项规范化的制度，却是源于美国。从实际情况来看，美国法院附设调解制度做得颇为成功，其完备的制度设计等使其较为顺利地解决了国内诉讼难的问题。现今，我国也同样经历着司法资源紧缺的情况。他山之石可以攻玉。我国法院调解又能从美国法院附设调解制度中得到怎样的启发呢？本文通过三个部分的内容试图对此问题做一些简要分析，并提出自己的观点。 第一部分，简要介绍与分析了美国法院附设调解。从法院附设调解的概念和美国法院附设调解的兴起介绍开去，简要分析其包括意思自治原则与强制调解、调解过程的程序规定、调解的保密原则以及宽松的调解人资格要求等特点。 第二部分，简要介绍与分...; China Court Mediation possesses a long history.
