| 英文摘要 | 医疗损害赔偿责任已经成为当今民法学界普遍关心的热点问题。一方面，多年来有关医疗纠纷案件的各种术语繁多且缺乏统一、规范性，规范法律用语是做好研究的前提；另一方面，2002年9月1日开始施行的《医疗事故处理条例》（以下简称《条例》）在广泛征求意见反复讨论修改后出台，有效解决了1987年国务院颁布的《医疗事故处理办法》的种种不足，但《条例》的施行又引发了医疗损害案件法律适用及技术鉴定的二元化，作为行政法规的《条例》与《民法通则》等相关法律及司法解释在医疗损害案件中的适用冲突问题也日益突出。《条例》作为一部行政法规，兼具行政性和司法性双重特征，不能够有效地解决复杂的医疗损害诉讼案件。2009年12月2...; Medical damage liability has become a hot issue generally concerned by the civil law scholars.
