英文摘要	内容摘要 自1993年我国《反不正当竞争法》颁行以来，各种新型的不正当竞争行为不断出现。但因现行《反不正当竞争法》对不正当竞争行为主要采取列举式，即只规定了11种不正当竞争行为，致使许多新出现的不正当竞争行为无法纳入到法律的调整范围，存在封闭性的缺陷。为此，必须制定一个完善的一般条款，以灵活应对未来可能出现的各种新情况和新问题。 在本篇论文中，共分五部分对反不正当竞争法的一般条款的现状与完善作一个分析。第一部分是一般条款概述，主要解决的是一般条款的基本理论问题。该部分从一般条款的含义、由来及功能等几方面对一般条款作一个较全面的阐述。第二部分主要是从法律的确定性和不确定性两方面对反不正当...; ABSTRACT China's "Anti-Unfair Competition Law" has been introduced since 1993, various kinds of new acts of unfair competition are emerging.
