| 英文摘要 | 河南洛阳“9.3性奴案”中，被囚的4名女子因协助李浩折磨一名女孩致死，涉嫌刑事犯罪，全部被检察机关以涉嫌故意伤害致人死亡批捕。该案引发的情、理、法的冲突，引起了我们对期待可能性理论的思考。 期待可能性，是指从行为时的具体情况看，可以期待行为人不为违法行为，而实施适法行为的情形。我国刑法上虽然没有对期待可能性做出明确规定，但是刑法典无论是在总则还是分则中都有相关制度，其对定罪和量刑都具有重要的意义。本文以河南性奴案为切入点，考察该理论的历史形成过程以及它的理论价值，结合我国当前的社会实际情形以及刑事司法的发展需要，笔者认为，期待可能性理论无论是在理论上，还是在实践上，都应当是一个急切需要引进的...; In the case of "9.3 sex slaves" in Henan Province, the four women imprisoned who had assisted Li Hao and tortured a girl to death were suspected of criminal offenses.
