英文摘要	随着经济的高速发展，城市生活垃圾已成为社会一大公害，制约着我国经济的可持续发展。在单一的行政规制无法解决我国日益严峻的城市生活垃圾问题之当下，我们能否重回到私法的立场，让私法为这个问题的解决贡献其应有的力量？答案是肯定的。我们应当充分发挥私法的激励机制，让民众自觉加入反对垃圾污染的大军中来，以减少垃圾的产生。进而，我们应当拆除部门法之间的隔离墙，打通公法和私法的边界，促进公法与私法之间的沟通与协调，使公法和私法共同服务于我们所奋斗的目标——构建资源节约型、环境友好型社会。 本文共分为四章。第一章从法律层面进行分析，得出城市生活垃圾问题产生的根本原因是处分自由，并提出应对处分权进行限制。第二章...; With the rapid development of economy, municipal solid waste (MSW), which has become a public nuisance, restricts the sustainable development of China’s economy.
