| 英文摘要 | 农民的痛苦就是社会的痛苦；农民和农村稳定，社会才能更稳定。纵观中国历史，任何一个政权的长治久安都离不开农民的安居乐业；任何一个政权的分崩离析都是在农民流离失所之时。最新的宪法修正案吹响了征地制度，特别是征地补偿制度改革的号角。此文的写作意图不在于诠释现行法规或指导实务操作，而是为征地补偿法律和政策的制定提供一定的理论支撑和参考性意见。文章共有五章：第一章对征地法律制度变迁史的评析，结合现行的法条，指出了征地补偿法律制度宏观和微观两个层面上的缺陷。第二章讲述了征地补偿二元结构的形成思路和框架结构，并分析了实行二元结构的必要性和可行性。第三章讲述了二元结构中的权利补偿部分，分析了土地权利的如何补偿...; The pains of the rural people are the pains of the society; the stabilization of countryside is the base of the stabilization of the society.
