| 英文摘要 | 最大诚信原则是被保险人与保险人订立海上保险合同的基础和核心原则。海上保险合同的特殊性，合同双方订立合同时信息不对称，以及保险标的远隔重洋，决定了合同当事人应该承担最大程度的诚信义务，即必须本着最大的诚意和信用来订立合同、履行合同。 本文旨在研究最大诚信原则在保险事故发生后，被保险人索赔和保险人理赔过程中的适用问题。最大诚信原则在海上保险中的适用不仅仅囿于说明、告知、通知义务等等，而是贯穿于海上保险合同订立、履行的整个过程。海上保险索赔理赔是保险事故发生后，合同履行的最终阶段。在此环节，被保险人虚报保险事故、夸大保险损失、隐瞒事故发生的真正原因等等产生一系列保险欺诈；同时，保险人借故各种原因拒...; The Principle of Utmost Good Faith is the foundation and core principle when the insured and the insurer entering into a contract of marine insurance.
