| 英文摘要 | 工伤认定程序是劳动者权利救济的重要途径，它是检验工伤保险法律制度是否完善的标准之一。我国现行工伤待遇给付以工伤认定为前提，工伤认定被设置为行政法律关系，如果劳动者与用人单位就事故是否属于工伤发生争议，需要通过行政诉讼的方式解决，而工伤待遇给付则需要通过仲裁或民事诉讼来解决。这种纠纷解决模式存在明显弊端，增加行政权与司法权的矛盾与冲突，造成工伤认定法律效果与社会效果一定程度的背离。为使工伤认定做到快速、便捷、低廉、高效，现阶段应当坚持程序效益、程序公正的价值要求，完善工伤认定程序制度。但从长远来说，应将工伤认定划归劳动仲裁的受案范围，使工伤认定更为科学合理，使劳动者的权益得到更为切实的尊重和保障...; The procedure of Industrial Injury Identification is an important way to relieve workers' rights, which is a criterion that inspect whether the industrial injury insurance legal system is consummate.
