| 英文摘要 | 《中华人民共和国涉外民事关系法律适用法》（以下简称《法律适用法》）于2010年10月28日通过，并自2011年4月1日开始实施，该法的一大亮点就是引入“经常居所”并将其作为我国属人法的首要连结点。这种规定具有突出的创新性与一定的合理性，如有利于加强我国对外来人员的管理，有利于我国区际属人法冲突的解决以及有利于我国与国际私法立法趋势接轨等等。但同时不可忽视的是，这种规定也具有一定的盲目性，并不符合我国移民输出国的国情。此外，该法还存在有关经常居所定义和构成要件的规定不合理、有关经常居所冲突解决机制的规定不健全、有关经常居所具体适用的规定不妥当等缺陷。法律规定的不足将给司法实践带来不少困难，亦有可...; Statute on the Application of Laws to Civil Relationships Involving Foreign Elements of the People’s Republic of China（thereafter the “Conflict Code”）was passed 28th October, 2010 and came into force on 1st April, 2011.
