| 英文摘要 | 注册商标的目的就是为了标识商品或服务的来源，而这一目的只有通过商标的使用才得以实现。注册商标不使用撤销制度是采取注册主义的大陆法系国家商标法中的一项重要制度。该制度设置的意义在于督促注册商标权人积极使用注册商标，减少注册商标的囤积现象，确保商标的识别机能得到有效的发挥。但是，我国现行法律和司法实践对此缺少明确的、统一的标准，以致在司法实践中认定商标权人的使用行为十分困难。 基于此，笔者分析注册商标不使用撤销中“使用”的界定原则，并适用界定原则全面分析了实践中的疑难情形，最后对完善我国《商标法》相关条款提出了自己的建议。 本文分为四章：第一章“注册商标不使用撤销制度概述”，介绍了注册商标不使...; The purpose of a trademark registration is to identify the source of goods or services, and this goal can be achieved only through use of the trademark.
