| 英文摘要 | 经过“民间版次贷危机”的阵痛和金融改革的蝶变，如今的温州企业不再谈“破产”色变或“走为上策”，而是更多地选择司法手段。2013年1月至9月，温州市两级法院受理破产案件数为190件，三个季度的收案数已经是2012全年的7倍，飙升的案件数让法院案多人少的矛盾凸显，冗长的审理周期让当事人对“公正和效率”产生质疑，司法实践在呼吁简易破产程序的诞生。2013年3月，温州市金融综合改革试验区成立，推进了温州全市法院对简化破产案件审理程序的先试先行。 本文第一章提出我国现行破产程序的问题现状，分析其造成企业破产退市路径受阻、司法效率低下、法院案多人少矛盾激化等三方面的原因。第二章讨论设立简易破产程序的可行...; Through of labor pains of “folk sub-prime crisis” and changes of finance reform, enterprises which fall into the fiancial trouble in Wenzhou today will not implement the principle of “Go for the best” any longer when facing bankrupt, but choose justice means more and more.
