| 英文摘要 | 随着国际投资数量与规模的增加，双边投资协定（以下简称“BITs”）在促进和保护投资方面发挥着越来越重要的作用。双边投资协定在为中国吸引大量外来投资、保护中国资本走向海外的同时，也因为协定内容存在的缺陷和不足，使中国面临越来越多的投资争端风险。在中国缔结的众多双边投资协定中，中德BIT具有典型意义。正是基于此，本文选取中德BIT，在对中德BIT与港德BIT作比较研究的基础上，总结中德BIT存在的不足之处，进而发现中外BITs存在的普遍问题。最后，本文结合2012年度《世界投资报告》出台的“新一代”投资政策，从适用范围、投资待遇和争端解决机制三个方面，提出几点完善中外BITs的具体建议。 除引言...; With the increase of the quantity and scale of international investment, the Bilateral Investment Treaties (BITs) play an important role in the promotion and protection of the investment.
