| 英文摘要 | 当前我国司法公信力与司法权威的缺失已是不争的事实，司法能力难以应对社会纠纷成为司法工作的主要矛盾。造成公众对法院不信任的原因很多，而我们应当关注的是法院自身在当前的环境下如何做得更好。面对着法律固有的局限和我国的社会现实，我们开展的“职业化”以及“对抗制”庭审模式等司法改革并没有相应提高司法权威，提高在整个社会中的公信力，反而由于引进的西方法律制度与本土社会存在冲突使得司法与公众渐行渐远，虽然法官付出了努力，但裁判结果却往往得不到公众的理解。“规则至上”是法治文明的基石，但简单地援引法律条文判决却未必能得到公众的认同。司法应当兼顾自身逻辑与社会需求，无论是强调规则的统治还是确立法律的至上权威，...; The current our country the public credibility of the judiciary and the lack of judicial authority is an indisputable fact, judicial ability to deal with the social disputes become the main contradiction of judicial work.
