英文摘要	“目的条款”普遍的出现在我国的立法文本当中，长期以来，对于我国法律文本当中为什么会出现这样的规定很少有学者进行系统的论述。然而，没有学者进行专门的论述并不代表这一条款对于法学研究而言毫无意义。相反，在本文看来，这一条款具有如下重要意义:首先从法治发展的视角来看，我们可以通过这一条款本身的变迁看到近代中国立法者关于法律观念的变迁，法律制度的沿革，以及立法者的这种关于法律观念的变迁如何影响到了中国的立法与司法实践;其次从法律运作的视角来看，“目的条款”对于一部法律而言具有什么样的意义，其对立法、执法、司法、法律监督等产生了什么影响等。 本文的第一章将重点研究“目的条款”自清末以降在中国法律文本中...; There is a strange phenomenon in Chinese laws,most of them have akind of clause which is called “the purpose clause”.
