英文摘要	随着保险市场竞争的白热化，代位求偿诉讼日益增多，而我国法律未对再保险人代位求偿权作出相应的规定。在保险代位求偿权案件审理中，对再保险人是否拥有代位求偿权，再保险人若有代位求偿权该如何行使等问题争议颇多。本文通过分析再保险人代位求偿权的理论基础，从一个案例引发法律思考，试图在对再保险人代位求偿权给予肯定的基础上，对再保险人行使代位求偿权做出探讨。以期能对我国再保险人代位求偿权制度的司法实践有所裨益。 除引言和结语外，本文共分成三个部分： 第一部分理论基础：主要介绍了再保险与保险代位求偿权的涵义，并对再保险合同的性质着重进行评析，得出再保险合同为具有责任保险性质的合同，为再保险人代位求偿权的享...; The litigation on the insurance subrogation is increasing as the competition in the insurance market is as fierce as ever.
