| 英文摘要 | 内容摘要 对于关心中国大陆民事纠纷解决乃至民事司法的人来说，“调解”是一个绕不开的命题。事实上，伴随最高人民法院“三个至上”，“重返马锡五审判方式”，“调解优先”等一系列政策的出台，法院调解复兴，乃至整个调解的复兴，甚至跨界“大调解”的兴起等等，都成为备受瞩目的对象。当学界对此或主张“冷思考”或报以“同情式理解”时，纠纷解决实践领域已从“调解率入绩效考评”、“零审判”、“建立立体调解机制”等举措来积极回应。“诉前联调”、“电视调解”等新类型、新方式的“调解”也应运而生。可以说，从理论到实践，“调解”跃出了其作为纠纷解决方式的“限界”，以社会治理重要方式的角色而得到了创造性的发挥。然而，从已修...; ABSTRACT To the persons who care about how to resolve civil disputes in China mainland and its civil judicature, Mediation System is one of the key issues which cannot be ignored.
