| 英文摘要 | 庇护是国际社会保护人权的一种方式，联合国宪章序言中规定：“重申基本人权，人格尊严与价值，以及男女与大小各国平等权利之信念。”可见保护人权是联合国的基本目的之一，也就是说庇护权保护人权与联合国保护人权的目的不谋而合。庇护制度有着可以追溯到远古的悠久历史。1793年，法国首次将庇护权载入宪法，现代很多国家的宪法都有庇护条款。多数学者过去多从国际法视角对庇护权进行研究，指出庇护权能增加本国的国际影响力。将庇护权置于宪政框架内研究，有别于前者，可视为庇护权研究的一个新方向。 自建国以来，我国就将庇护权（居留权）纳入具有宪法性质具有宪法性质的《共同纲领》和历部宪法中。中华人民共和国现行宪法，即1982...; The institution of asylum has a long history .The right of asylum as institutional guarantee of constitution was born in the French Constitution of 1793.Many countries have constitutional provisions for asylum.
