英文摘要	关于量刑基准的定义国内外有诸多学说。狭义说认为量刑基准是指某一犯罪在典型形态下应当适用的一定的刑罚分量。广义说认为量刑基准是指量刑时应当考虑的对象以及在量刑的过程中应当依据的原则。其内涵包括量刑要素和量刑原则两部分。本文通过比较研究的方法，从量刑基准的广义内涵出发，通过对中英刑法中量刑基准的法律根据、确立原则和构成要素进行分析比较，藉以透析出两者之间的重大区别，并以此为基点，进而对我国量刑理论之担纲的现行量刑基准理论与实践作进一步的批判与反思，并提出完善我国量刑基准的建构方案。 文章包括引言、正文和结语。正文部分共分为五章，第一章从量刑基准的内涵和外延出发，列举了中国关于量刑基准的基本学说以...; There are many theories concerning the definition of basic criterion of sentencing in the domestic and overseas.
