| 英文摘要 | 会诊医疗广泛存在于医疗实践，对于维护人民群众健康、提高医疗水平具有重要作用。然而在医疗诉讼纠纷成为社会关注的焦点，恶性袭医事件不断发生的社会大背景下，作为医疗诊治重要组成部分的院外会诊医疗也不能幸免。面对情绪激动的患者以及百口莫辩的医院或者医师，要想判断孰是孰非及由此引起的赔偿责任绝非易事。鉴此，本文试图通过对院外会诊医疗的法律性质以及现行立法的分析，找出院外会诊医疗在法律规制中应处的位置，并借此提出完善我国院外会诊医疗损害赔偿责任制度的立法及司法建议。 第一部分包含三个方面的内容，一是界定我国院外会诊医疗损害赔偿责任的范围，如传统的医疗会诊、远程会诊和私人会诊；二是介绍现行我国院外会诊医疗...; Clinical consultancy exists broadly in practical,which plays an important role in maintaining a health and improving medical care standards.But the clinical consultancy also cannot avoid the phenomenon that the medical dispute is focused on and the incident of attacking doctors often happens .Facing emotional patients and innocent doctors, it is difficult to judge what is wrong and what is right...; 学位：法律硕士; 院系专业：法律硕士教育中心_法律硕士(JM); 学号：13020111150269 |
