英文摘要	钓鱼岛主权归属争端是中日关系发展的障碍,双方政府及有关学者在国际法方面各持己见。然而,关于领土取得的国际法规则有失明确性,现代国际法与传统“中华世界秩序“之间在领土观念上尚未互相兼容,因此,国际法在解决钓鱼岛争端中的重要性和有效性不可高估。此外,中日双方难以达成将钓鱼岛争端诉诸国际司法机制的合意,当前国际司法机制实践中的文化偏见与海峡两岸政治互信的不足,也使得国际司法机制在钓鱼岛争端中的作为空间大打折扣。鉴此,未来钓鱼岛争端的解决仍应重视政治手段的作用,并审慎而渐进性采用法律解决方法。; The sovereignty dispute over the Diaoyu Islands is the main obstacle to the development of the Sino-Japanese relations.Both the governments and scholars of the two countries stick to their own opinions in international law.However,due to the vagueness of the international rules on the acquisition of territory and the incompatibility of the traditional Chinese World Order with modern international law,the importance and effectiveness of international law on the sovereignty dispute over the Diaoyu Islands cannot be overestimated.In addition,the Chinese and Japanese governments' reluctance to submit the dispute to international courts and tribunals,the cultural bias displayed in international judicial practice and the inadequate mutual political trust between the governments across the Strait limit the role of international judicial mechanism in this issue.In view of this situation,the future settlement of the dispute over the Diaoyu Islands,the writer believes,can be made by political means and through legal approach in a prudent and progressive manner.; 教育部人文社会科学重点研究基地重大项目“国家尚未统一特殊情况下的两岸政治关系研究”(12JJD810011); 教育部区域与国别研究培育基地厦门大学港澳台研究中心专项课题“国际视野下的钓鱼岛与保钓运动研究”
