英文摘要	[中文文摘]陈水扁上台以来,一直图谋通过“宪政改造”实现“法理台独”,先后提出了“公投制宪”、“催生新宪法”、“第二阶段宪改”等主张,其目的是彻底去除台湾法律体系中的“法理一中”架构。但是陈水扁为了掩人耳目,在“宪政改造”的具体内容中强调“行政体制改革”、“新闻自由”、“18岁公民权”等;在政治手段上则强调自下而上,并与选举动员相结合。然而,没有国民党的支持,没有民意的支持,陈水扁推动的“新宪公投”不可能成功。[英文文摘]After Chen Shui-bian taking into his office, it’s always his purpose to pursue “de jure independence” through “constitutional reform”. He advocated such ideas as “making constitution through referendum”, “urging to draft a new constitution”, “the second-phase of the constitutional reengineering project”, and is intentionally to abolish the “one China framework” in legislative system of Taiwan. In order to deceive the public, Chen Shui-bian stressed the specific articles such as “executive system reform”, “press freedom”, “eighteen’s citizenship”, and etc. He also stressed the “bottom-up” approach combined with the electoral movements. But without the support of KMT and the people, it is impossible for Chen Shui-bian to succeed in “holding a referendum on the new Constitution”.
