英文摘要	原旨主义与活的宪法长期被视为两种针锋相对的宪法解释理论,但巴尔金却认为两者相互兼容。基于宪法是一项融合过去、现在和未来的自治事业,以及宪法解释非为司法机构专有,也是且主要是政治部门和人民的活动这两项前提,通过引入宪法信仰和宪法救赎理念,以宪法作为基本法、高级法及“我们的法律“为正当基础,巴尔金最终证成了我们不仅可以因应时代变迁发展宪法,而且仍然忠于原初宪法文本——活的原旨主义理论。这种理论为我们如何对待宪法指明了方向。; Though originalism and living constitution have been treated as two opposite approaches of constitutional interpretation,Professor Balkin argues that they are compatible.In Living Originalism,it is based on two presumptions:(1) Constitution is a project of self- governance that synthesizes the past,the present and the future;(2) constitutional interpretation is not only the activities of the judiciary,but also and mainly those of the political branches and the people.Balkin invokes the ideas of constitutional faith and constitutional redemption,and finally justifies that we can develop our constitution as time passes,while still be faithful to it—the theory of Living Originalism,whose legitimacy is rooted in the idea of the constitution as basic law,higher law and our law.Balkin's theory reveals how we should treat our constitution.; 司法部国家法治与法学理论研究项目“美国法上作为征收理由的公用判断标准”(项目编号:14SFB2009)
