英文摘要	人权本身是一个复合性概念,其在不同语境中呈现出不同的面向。语用学是指对语言的理解和运用,它强调对话语研究的情境性。基于语用学的人权概念分析,可以将人权放置到历史语境、文化语境、政治语境、制度语境中,考虑到人权概念所内涵的变迁性、习俗性、双重性与实践理性特征,对法治中国语境中人权概念的理解,需要综合考虑中国传统社会历史积淀、中西法律文化融合、中外政治话语纷争、以及中国人权制度化实践等几个方面的因素。在推进法治中国建设的大背景下,进一步明晰不同语境中的人权概念,有助于加深对人权的理解,从而有益于深入推进法治目标的实现。; Human Rights itself is a complex concept,which presents a different face in different contexts.Pragmatics refers to the understanding and use of language,which emphasizes the situational studies of the concept.Based on pragmatics analysis method,the concept of human rights is placed into the historical, cultural, political, and institutional context.The connotation of the concept of human rights is taken into consideration,including transitional,customary,duality,and Practical Reason features.Within the rule of lawcontext of China,to understand the concept of human rights,people need to consider the social and historical heritage of Chinese traditional, Chinese and Western legal culture integration, political disputes home and abroad,as well as such factors as China's human rights institutionalized practice.In the newera,against the background of promoting the construction of the rule of lawin China,clarifying the concept of human rights in different contexts will be helpful to deepen the understanding of human rights and do good to promote the realization of the beneficial goals of the rule of law.; 福州大学科技发展基“人权制度化研究”(项目编号:14SKQ10)的阶段性研究成果
