英文摘要	“风水热“的兴起导致风水纠纷在现代社会依然广泛存在,然而,对风水纠纷的解决途径却不甚明了。基于对风水纠纷特点的归纳,运用“诉的利益“和“形成中的权利“理论,论证风水纠纷何以能够被法院受理。在裁判依据方面,国家法能力的不足和对法律多元理论的认可为民间法的适用提供了空间。但民间法的双重属性决定了需要在裁判过程中强化程序规制,以限制法官的自由裁量权。具体程序规则包括:论证时重视“有专门知识的人“的意见,识别时强调人民陪审员的适度参与,裁判时进行充分说理。; Because of the rise of advocates of Feng Shui,Feng Shui disputes still exist widely in modern society.However, haw to solve the disputes is unclear.Based on summing up the characteristics of Feng Shui disputes,using the "interest of action"and "forming rights " theory,why the court shall entertain the lawsuits filed in respect of Feng Shui disputes is demonstrated.Lack of constitutional law and the theory of plural law provite suitable rooms that the folk law can be applicable as the basis of decision by the courts.But the procedure regulation should be strengthened in the process to restrict the discretion of judges because of the dual attributes of the folk law.Specific rules of procedure include: the opinions of people with professional knowledeg should be taken seriously; people 's assessor should take part in the process of identification moderately; when deciding a case,judges should argue in adequacy.
