英文摘要	天、祖宗之法以及士大夫是古代君权制约的三个基本要素,三者之间有联系有互动,士大夫以自身的能动性,利用天与祖宗之法对君权形成理念与制度层面的制约。但是,王安石变法的“三不足“使之受到了破坏,结果其变法是以君主独裁来实现的,从而使得国家制度遭到进一步破坏,败坏了政治根基。有鉴于此,在社会主义法治建设过程中,必须处理好权力与法治的关系,一方面要确立社会主义的分权原则,另一方面则要尊重法治权威,尤其要尊重宪法权威。; The heaven,the law of ancestors and literati are essential factors which control the ancient monarchical power.There are link and interaction among them.The literati which have their own initiative,use the heaven and the law of ancestors to control idea and institution of monarchy.But "the Three Deficiencies" in Wang An-shi reform damaged that,and the reform was implemented using the autocratic monarchy.It made the state system and the political base further damaged.This paper proposes to manage the relationship between the power and the rule of law in the process of building the socialist rule of law,firstly the principle of separation of powers need be built,secondly,we should respect the authority of the rule of law,especially the authority of the constitution.
