英文摘要	国际反恐行动给予了传统国际公法“自卫权“以新的发展空间,然而“自卫权“概念本身尚存在较多模糊之处,如果不能结合国际法实践及遵从国际法精神与原则,很有可能使得国际法与国际政治之间的鸿沟愈加扩大,甚至架空《联合国宪章》所确立“不得使用武力“的基本原则。另外,类似“定点清除“这样一种全新的反恐手段实际上隐藏着巨大的法律陷阱——因为无论从国际公法还是国际人道法来看,“定点清除“都面临着一系列的合法性危机。; International anti-terrorism has given the self-defense of traditional international law new spaces to develop.However, ambiguities still exist in the concept of self-defense.If we cannot combine this concept with practice of international law and comply with the spirits and principles of international law, the gap between international law and international politics would widen, even undermining the principle of prohibition against the use of force established by United Nations Charter.In fact, novel means of anti-terrorism such as targeted killing hide huge legal traps —— from the prospective of both international law and international humanitarian law, targeted killing faces crisis of legitimacy.
