英文摘要	电商标价错误案引发两岸民法学界对传统意思表示错误制度之共同关注。台湾地区民法错误论源自罗马法—德国法传统,并受到日本法的一定影响。在错误类型上,台湾地区民法沿袭德国“内容错误“与“表示行为错误“之界分,性质错误“视为“内容错误。在错误撤销上,创造性地增加了表意人过失要件之限制,相对人之可归责性亦成为影响表意人行使撤销权之考量要素。两岸民法错误论存在着内生机理上的共通,使得大陆民法错误论寻求台湾地区经验之借鉴成为可能。; The cases of pricing error in electricity business attract the common attention of the Cross-Strait civil law scholars to the traditional error system.The civil law error theory in Taiwan mainly originated from Roman-German law tradition,and at the same time,was influenced in some way by the Japanese law.In the type of error,the civil code of Taiwan area has still followed from Germany the"content error"and the"expression of behavioral error",and the"nature of error"is regarded as "content error".In the error cancellation,it is creatively added that negligence as a limitation to a bidder is demanded.In addition,the imputation of the opposite party becomes a main factor affecting the exercise of the right of the bidder's revocation.In fact,inherently there have been a lot in common in the error theory across the Strait,which makes it possible for the mainland scholars to seek Taiwan's experience to use for reference; 台湾地区“中华发展基金会”2011年度大陆法学博士生赴台研修计划资助
