英文摘要	反垄断执法极具弹性,反垄断执法机构拥有巨大的自由裁量权。反垄断执法专业性强,经济分析应用广泛。司法审查是监督反垄断执法和保护相对人利益的必要机制,但司法审查必须与反垄断执法的特点相适应。反垄断执法的司法审查往往面临审查标准不明、审查专业性强、审查强度难以把握等诸多难题。为了促进反垄断执法司法审查的顺利开展,我国应该采取有效措施解决相关问题,完善司法审查机制。同时要完善反垄断立法,明确司法审查依据和标准,确立全面审查原则,合理把握司法审查强度,健全审判组织。; The enforcement of anti-monopoly law has high uncertainty due to the anti-monopoly authorities have great discretionary power.The enforcement of anti-monopoly law is thus a professional activity,and the economic analysis is widely adopted in the enforcement of anti-monopoly law.Although the judicial review is a necessary mechanism to supervise the enforcement of anti-monopoly law and protect the rights and interests of relevant parties,the judicial review should be adapted to the features of the enforcement of anti-monopoly law.At present,the judicial review on the enforcement of anti-monopoly law has many difficult problems,such as the uncertainty of the standards of judicial review, the high specialty of the review, and the tough determination of intensity of judicial review.In order to promote the smoothly development of judicial review on the enforcement of anti-monopoly law in China,China should take effective measures to perfect the judicial review mechanism.At the same time,it is also necessary to perfect the lawmaking of anti-monopoly law,clarify the standards of judicial review,establish the principle of comprehensive review,control the strength of judicial review,and improve the judicial organizations.; 国家社科基金项目“公用事业反垄断利益冲突与协调研究”(项目编号:11BFX057); 2011年厦门大学基础创新科研基金(中央高校基本科研业务费专项资金)资助项目“反垄断执法规范化问题研究”(项目编号:2011221019)的成果
