英文摘要	诉讼和调解其实都不放弃对事实真相的追求。多元化和流动性的诉调对接程序具有一定的中间性质,其事实基础更侧重于一种以当事人单方或者双方对证据进行初步加工而形成的关于事实的意见为前提。也就是说,诉讼或者调解程序中达成的意见可能在其后的程序转化中相互作为证据材料或者裁决根据。意见共通于诉讼和调解程序之间,这一方面重新解释了调解保密原则,另一方面也体现了辩论原则的要求和司法权的社会性本质。; The pursuit of truth is the aim of both litigation and mediation.In the multiple and mobile Connection System of Litigation with Mediation,the fact foundation takes the premise of factual opinion which is the result of pretreatment to evidence by the parties unilateral or bilateral.That is to say,the opinions reached in the proceeding of litigation or mediation can mutually use as evidentiary materials in the successive proceeding transformations.The currency of opinions in and out the procedures of litigation and mediation reinterprets the principle of conciliation confidentiality and is backed by the advocacy of probative right and sociality of judicial power.; 教育部人文社会科学研究青年项目(09YJC820058); 福建省社会科学规划一般项目(2011B207)
